Shanahan & Shanahan assist governmental units in all stages of such transactions from the designation of the project area through the financing of the redevelopment. As a redevelopment project progress the assessed value of the area increases, and property, sales and/or other taxes are generated. The new revenues generated and attributed to the increase in the value of the project area are pledged to the payment of bonds or other obligations issued to induce the redevelopment.
Shanahan & Shanahan will help issuers with the legal and tax issues that accompany the structuring of these transactions, including: the management of the “waterfall” of funds as they are collected, lien priority on revenues, negotiation of covenants with interested parties, arbitrage restrictions, refunding requirements, and any other issue that may arise.
